Terms of Use
These Terms of Use explain how you may use the XSECAPE website and services, what you can expect from us, and the important conditions that apply when you work with XSECAPE LLC for travel planning, advisory, concierge, and related services.

1. Acceptance of Terms
By accessing our website, contacting us, using our services, or booking travel through XSECAPE LLC (“XSECAPE,” “we,” “us,” or “our”), you agree to be bound by these Terms of Use.
If you do not agree to these Terms, please do not use our website or services.
2. Who We Are
XSECAPE LLC is a travel advisory and concierge company. We help clients plan, coordinate, and manage travel experiences, including domestic and international travel, curated itineraries, luxury experiences, group travel, and other travel-related support services.
XSECAPE is a Travel Advisor and not a direct provider of flights, hotels, resorts, cruises, tours, ground transportation, or other travel supplier services unless clearly stated otherwise.
3. Scope of Services
Our services may include, but are not limited to:
- Travel consultations and destination guidance
- Custom itinerary planning
- Pre-planned itinerary recommendations
- Hotel, resort, transportation, and excursion coordination
- Group travel planning
- Luxury and premium travel advisory services
- International relocation and extended-stay planning support
- Travel concierge-style support before and during travel
Please Note: The exact scope of services depends on the package, consultation,
or service selected by the client.
4. Our Role as a Travel Advisor
XSECAPE acts as an independent travel advisor for the client. We research, recommend, and coordinate travel services based on your requests and preferences.
We do not own or control the airlines, hotels, resorts, cruise lines, transportation companies, tour operators, activity providers, or any other third-party travel suppliers used in your trip.
Because of this, XSECAPE cannot guarantee the actions, performance, availability, quality, safety, or conduct of any third-party supplier.
5. Third-Party Suppliers
Travel bookings arranged through XSECAPE are fulfilled by independent third-party suppliers. These may include airlines, hotels, vacation rental providers, transportation providers, cruise lines, travel insurance companies, tour operators, and excursion companies.
By using our services, you understand and agree that:
- You may be entering into separate agreements with those suppliers
- Each supplier has its own terms, conditions, rules, and cancellation policies
- Those supplier policies apply in addition to these Terms of Use
- XSECAPE is not responsible for supplier actions, failures, delays, cancellations, service issues, or pricing changes
6. Advisory Fees, Planning Fees, and Service Charges
XSECAPE may charge separate fees for consultations, planning, itinerary design, concierge support, administrative work, visa and customs guidance, group travel planning, premium services, and related travel advisory services.
Important Fee Terms
- Our service fees are separate from the cost of your trip, accommodations, flights, excursions, and travel products
- Rates and fees are subject to change at any time without notice
- Prices shown are generally before any applicable promotional, supplier, or discounted rates unless otherwise stated
- All service fees paid to XSECAPE are final and non-refundable unless we expressly state otherwise in writing
Reminder: Paying a XSECAPE planning or advisory fee pays for our time, expertise, research,
coordination, and support. It does not guarantee supplier availability, price locks, upgrades, approvals,
visas, or specific travel outcomes.
7. Payments and Authorization
When you provide payment information to XSECAPE, you authorize us to charge the applicable fees for the services you selected and, where authorized, to process payments related to your travel arrangements.
You represent that:
- You are authorized to use the payment method provided
- All billing information you provide is accurate and complete
- You are responsible for all charges incurred on your behalf
Failure to make timely payment may result in cancellation of planning work, itinerary holds, or supplier bookings.
8. All Sales Final / No Refunds
Unless otherwise stated by XSECAPE in writing, all payments made to XSECAPE for advisory, consultation, planning, itinerary, and concierge services are:
- Final
- Non-refundable
- Non-transferable
Refunds, credits, travel vouchers, or future travel value related to flights, hotels, tours, transportation, or other supplier products are governed solely by the supplier’s own rules and policies.
9. Pricing, Availability, and Booking Conditions
Travel pricing and availability can change quickly and often without warning. Quotes provided by XSECAPE are not guaranteed until booking is confirmed and full or required payment is received by the applicable supplier.
Supplier inventory, airfare, room categories, rates, promotions, and special offers may change between the time a quote is shared and the time a booking is made.
XSECAPE is not responsible for changes in supplier pricing, inventory limits, blackout dates, sold-out conditions, or withdrawal of promotional offers.
10. Changes, Cancellations, and Travel Disruptions
Travel plans may be interrupted, changed, or canceled due to weather, supplier operations, natural disasters, labor disruptions, government action, public health issues, security concerns, or other events outside of our control.
By using our services, you understand and agree that:
- All changes and cancellations are subject to the supplier’s rules and penalties
- Additional fees may apply for changes, rebooking, revisions, or cancellations
- XSECAPE is not responsible for penalties, losses, missed connections, missed activities, or added costs caused by disruptions
- Any advisory fees already paid to XSECAPE remain non-refundable
11. Travel Documents and Entry Requirements
You are solely responsible for obtaining and carrying all required travel documents and meeting all entry, exit, health, identification, and legal requirements for your destination and transit points.
This includes, but is not limited to:
- Valid passports
- Visas and entry approvals
- Vaccination or health-related documentation
- Customs declarations
- Required identification
- Compliance with local laws and regulations
While XSECAPE may provide general guidance, we do not guarantee that any information is complete, current, or accepted by government authorities. Final responsibility always remains with the traveler.
12. Health, Safety, and Travel Risks
Travel involves inherent risks, including illness, injury, delays, accidents, crime, political instability, weather events, transportation disruptions, and other unforeseen issues.
By choosing to travel, you knowingly and voluntarily accept the risks associated with domestic and international travel.
XSECAPE is not responsible for injuries, losses, damages, delays, inconveniences, or other harm that may occur during or in connection with travel.
13. Travel Insurance
XSECAPE strongly recommends that clients purchase appropriate travel insurance coverage, including coverage for trip cancellation, interruption, delays, medical emergencies, baggage issues, and other travel-related risks.
If you decline travel insurance, you accept full financial responsibility for any losses, disruptions, or expenses that may arise before, during, or after travel.
14. Special Requests and Preferences
XSECAPE may communicate special requests to suppliers, including room preferences, bed type requests, accessibility needs, dietary preferences, celebration notes, or upgrade requests.
However, all such requests are subject to supplier availability and approval. XSECAPE does not guarantee that a supplier will honor or confirm any special request.
15. Group Travel
Group travel arrangements may involve separate contracts, deposits, payment schedules, cancellation rules, rooming requirements, and supplier terms.
If you are organizing or participating in a group trip coordinated by XSECAPE, you may be required to agree to additional terms specific to that group experience.
XSECAPE is not responsible for the actions, failures, cancellations, non-payments, or behavior of other travelers in the group.
16. XSECAPE Privé
XSECAPE Privé is the luxury and premium division of XSECAPE. Services may include luxury accommodations, elevated dining experiences, premium transportation, curated excursions, and personalized concierge support.
Luxury services may be subject to stricter deposit requirements, tighter cancellation terms, limited supplier availability, and higher supplier penalties.
All Privé services remain subject to third-party supplier rules unless clearly stated otherwise.
17. XSECAPE Air
XSECAPE Air is the aviation-related division of XSECAPE. Unless expressly stated otherwise in writing, XSECAPE Air acts as a travel coordinator, broker, or arranger for private aviation-related services.
XSECAPE Air is not a direct air carrier unless specifically identified as such. Flights and aviation services are generally operated by properly licensed third-party operators under applicable laws and aviation regulations.
Aircraft availability, routing, operating restrictions, weather conditions, safety requirements, and operator approval may affect the final service delivered.
18. Website Use
You agree to use our website only for lawful purposes. You may not:
- Use the site for fraudulent, unlawful, or abusive activity
- Attempt to gain unauthorized access to our systems or website
- Copy, scrape, reproduce, or misuse our content without permission
- Upload harmful code, malware, or disruptive material
- Misrepresent your identity or submit false information
19. Intellectual Property
All content on the XSECAPE website, including text, graphics, branding, logos, layouts, design elements, and original materials, is owned by or licensed to XSECAPE LLC unless otherwise noted.
You may not copy, reproduce, distribute, publish, display, modify, or commercially use our content without prior written permission from XSECAPE.
20. No Warranties
XSECAPE provides its website and services on an “as is” and “as available” basis. We do not make any promises, warranties, or guarantees, express or implied, regarding:
- The accuracy or completeness of information
- The availability of travel pricing or inventory
- The performance of third-party suppliers
- Uninterrupted website operation
- Specific travel results, upgrades, or experiences
21. Limitation of Liability
To the fullest extent permitted by law, XSECAPE LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of money, loss of opportunity, loss of enjoyment, business interruption, missed connections, or other travel-related losses.
XSECAPE is also not liable for the acts, omissions, negligence, errors, delays, defaults, cancellations, overbookings, bankruptcies, or failures of any third-party supplier.
If liability is ever found against XSECAPE despite these Terms, our total liability shall not exceed the amount of advisory or service fees actually paid directly to XSECAPE for the specific service at issue.
22. Indemnification
You agree to defend, indemnify, and hold harmless XSECAPE LLC, its owners, members, managers, officers, contractors, advisors, affiliates, and representatives from and against any claims, liabilities, damages, losses, costs, and expenses, including reasonable legal fees, arising from:
- Your use of our website or services
- Your travel activities
- Your violation of these Terms
- Your dispute with any supplier or third party
- Your negligent, unlawful, or wrongful acts or omissions
23. Force Majeure
XSECAPE shall not be responsible for any delay, cancellation, disruption, or failure in performance caused by events beyond our reasonable control, including but not limited to natural disasters, severe weather, war, terrorism, civil unrest, labor disputes, public health emergencies, epidemics, pandemics, government action, transportation failures, or supplier shutdowns.
24. Privacy
Your use of our website and services is also subject to our Privacy Policy, which explains how we may collect, use, store, and share information related to your inquiries, bookings, and travel planning.
25. Modifications to These Terms
XSECAPE reserves the right to update, modify, revise, or replace these Terms of Use at any time without prior notice.
Your continued use of our website or services after any update means you accept the revised Terms.
26. Governing Law
These Terms of Use shall be governed by and interpreted under the laws of the State of New Mexico, without regard to conflict of law principles.
27. Dispute Resolution and Arbitration
Any dispute, claim, or controversy arising out of or relating to these Terms, your use of the XSECAPE website, or any service provided by XSECAPE shall be resolved through binding arbitration in the State of New Mexico, unless XSECAPE elects otherwise in writing.
By using our services, you agree to waive the right to a jury trial and waive the right to participate in any class action, collective action, or representative proceeding to the fullest extent allowed by law.
